What is Section 18 of RERA?

Section 18 of the RERA Act, 2016 mandates that if a builder fails to deliver possession by the agreed date, the buyer is entitled to interest at SBI MCLR + 2% per annum on the total amount paid. The buyer can either stay in the project and claim monthly interest, or withdraw and claim a full refund with interest.

What interest rate applies to RERA delay penalty?

The RERA Act specifies SBI Marginal Cost of Lending Rate (MCLR) plus 2% per annum. As of July 2026, SBI's 1-year MCLR is 8.70%, making the effective penalty rate 10.70% per annum. Some states have different rates - Uttar Pradesh uses MCLR + 1%, while Andhra Pradesh and Chhattisgarh use Prime Lending Rate + 2%.

Is RERA delay penalty taxable?

Yes. RERA delay interest received is taxable under "Income from Other Sources" at your applicable income tax slab rate. There is no specific exemption for RERA compensation under current tax law.

Can I claim RERA penalty if my project is not RERA registered?

Only RERA-registered projects are covered. Projects completed before RERA's commencement (May 2017) or land/plot sales are generally excluded. Verify registration on your state's RERA portal before filing.

What is included in "amount paid" for RERA penalty calculation?

All payments made to the developer count: booking amount, construction-linked instalments, parking, PLC, club membership, and other charges in the sale agreement. Stamp duty and registration paid to the government are excluded.

How long does a RERA complaint take to resolve?

The RERA Act mandates resolution within 60 days. In practice, MahaRERA resolves complaints in 3-6 months; states with higher caseload may take 9-18 months. An interim order is often obtainable within 30-60 days.
